Snowspace Products Availability

In agreement with the owner of the Snowspace® rental centre, should the model chosen and booked by the customer be unavailable when he arrives at the shop, we undertake to provide him with equipment of the same or a higher standard at no extra charge.

Terms and Conditions for Snowspace Online Rental:

Tecnica S.p.A., an Italian company with registered office in Via Fante d'Italia, 56, Giavera del Montello (Treviso), Tax Identity Code and VAT No. 00195810262, registered in the REA (Economic Administrative Directory) of Treviso under No. 78175 (hereinafter referred to as 'TECNICA Group') manufactures and sells products including skiboots, skis, bindings, helmets and poles in various ranges and models around the world. These products are distinguished by different brands, which belong to, are licensed to and/or distributed by the Group itself (hereinafter referred to as 'Products').

TECNICA Group has developed a project called SNOWSPACE whose aim is to assist a selected number of its clients in the creation of rental centres in leading Italian ski resorts where its Products may be rented. Ski equipment may be booked directly on the Internet and collected at the shops which are part of the SNOWSPACE project.

Booking ski equipment through the website www.snowspace.it implies acceptance of the general rental conditions detailed below. The general rental conditions may be subject to amendment; the conditions which will be applied are those in force on our site www.snowspace.it (Site) on the day of the booking. Users must register if they wish to take advantage of the services offered on the website and, more importantly, if they wish to submit their booking. Anyone wishing to register must guarantee that the personal data supplied are true, correct and up-to-date.

Clause 1: Booking the rental equipment

1-1: Rental equipment

All the equipment available for rental is described on the website www.snowspace.it. The customer may also specify the type of equipment he wishes to rent when making the booking (standard equipment) or may choose a specific model (Snowspace Selection option). Since the Snowspace Selection option allows customers to choose their equipment, they may book up to 10 days prior to arrival at the ski resort.

Since each shop is free to decide whether or not to offer the Snowspace Selection option, if the service is available, customers will be informed of the possibility of choosing a specific model - with the instruction book on line which will appear on the booking page - at the cost indicated on the website at the time of booking.

- Satisfied or higher category guarantee: should a model, which has been chosen and booked by the customer, be unavailable when he arrives at the shop, we undertake to provide him with equipment of the same or a higher standard .

1-2 : Rental prices.

Rental prices depend on the category of equipment booked by the customer, the resort chosen and the rental period. These prices are in accordance with rental charges applied in the shops which are part of the SNOWSPACE project and are posted on the individual site of each rental centre.
All prices are inclusive of taxes.

1-4 : Formation of contract.

The booking is to be considered completed and takes effect when the customer receives an electronic message confirming the rental. The rental details will appear on this confirmation as well as a voucher, which the customer must print out and present at the SNOWSPACE shop he has chosen. When booking the rental equipment, the customer must guarantee that the information he has provided is correct and he undertakes all liability for the correctness and feasibility of the booking. Should there be any change in the information provided by the customer, he will be responsible for notifying the Shop as soon as possible.

TECNICA GROUP/Shop reserves the right to refuse a booking request if the customer does not provide all the necessary information to access the services offered. Similarly, should the electronic systems or operating software malfunction or if the information posted on the Site is inaccurate or incomplete for reasons beyond their control, the booking will be refused.

Should an order be refused, TECNICA GROUP/SHOP will not debit the customer any amount and will contact him (via e-mail, fax or telephone) at the address provided as quickly as possible to inform him of this decision.

Clause 2: Making available and returning rental equipment - Duration of rental

Rental takes effect when the customer takes possession of the equipment in the SNOWSPACE shop and ends on the date when he returns it, in accordance with the length of time indicated on the voucher which must be printed out by the customer and handed in to the chosen SNOWSPACE shop. The customer is responsible for the rental ski equipment as soon as it is issued to him. He shall look after it and use it with normal due diligence at all times. The customer must notify the SNOWSPACE shop as soon as possible if he will be collecting the rental equipment later than indicated. We ask the shop to hold the reserved equipment for 24 hours. Once this time is up, the equipment will be made available for rental without refunding any monies to the customer. Rental equipment shall be returned to the SNOWSPACE shop where it was issued. Failure to return the rental equipment, regardless of the reason, will result in the shop in question invoicing the customer the full value of the equipment based on its current sales price to the public, in addition to the rental cost.

Clause 3: Usage of rental equipment

The rental equipment is for the customer's personal use and under no circumstances shall he sub-rent or lend it, even free of charge. The customer alone shall be the sole judge of whether he is capable of using the rental equipment and whether he has the ability to make use of the items he has rented. The customer undertakes to use the rented items with due care and attention without endangering third parties in accordance with the regulations in force and to ensure that the equipment is finely adjusted and made safe exclusively by people authorised to do so, immediately notifying the shop of any anomalies. All equipment available for rent is deemed as being in good condition and shall be returned in the same state. Any damage to the equipment, whatever the cause, will result in the customer paying the shop directly for equipment replacement or repair, in addition to rental costs; the maximum limit of the replacement/repair costs will be the cost of replacing the equipment "as new".

Clause 4: Availability of the equipment for rent

With the exception of the Snowspace Selection option, TECNICA Group/Shop will not be liable for delays in the availability of rental equipment due to reasons beyond their control, such as in the case of an accident, delay in the previous customer returning the equipment, amendment of regulations, force majeure, strikes, etc. In such circumstances, the TECNICA Group and Shop will do their best to provide the customer with equipment of the same or higher standard, depending on stock availability in the shop in question.

Clause 5: Inassitalia third party liability insurance cover upon request

Customer must enquire about insurance cover directly at the rental centres taking part in the offer in order to make it operative.

Clause 6: Cancellation policy

The customer may cancel the rental agreement up to 10 days after confirmation of the booking. If the end of this period falls on a Saturday, Sunday or a Bank or Public Holiday, it shall automatically be extended to the next working day. However, the right to withdraw from the agreement may not be exercised if the rental period has begun, with the customer's consent, before the expiry of the seven-day period.

6-1 : Withdrawing from the rental agreement
If the customer wishes to exercise his right to withdraw from the rental agreement, he must send written communication directly to the rental centre where he made the booking by registered letter with return receipt before the deadline. The communication may be sent by telegram, telex or e-mail within the same deadline, provided it is then confirmed by registered letter with return receipt within the next 48 hours. Should a customer exercise his right to withdraw from the agreement within the deadline of 10 days, all monies paid by the customer will be refunded in full. The refund will be made directly by the shop where the material was booked.

6-2 : Cancellation before the equipment is collected and after the withdrawal deadline.

No refund will be made.

6-3 : Cancellation after the equipment has been issued.

In the case of accident or illness during the rental period, the rental conditions still apply. Only the equipment used by the person concerned may be returned and will be invoiced on a pro-rata basis for the number of days it was actually used (a medical certificate will be required). Any refunds will be made at the rental centre. If a day's rental has already begun, it will not be refunded.

6-4 : Cancellation due to bad weather.

In the case of total closure of the ski area, which is normally accessible from the rental centre where the equipment has been booked, and only in this case, the customer will be reimbursed for the days he has been unable to use the equipment. A document justifying this closure issued by the ski lift company of the resort will be required. Any refunds will be made at the rental centre.

Clause 7: Personal data

TECNICA GROUP and the shop declare that customers' personal data, which are acquired when customers consult the website and/or use the services offered on the website, will be processed in compliance with the obligations of Italian Legislative Decree No. 196 dated 30 June 2003 describing the Personal Data Protection Code and with the methods and for the purposes set down in the Privacy Policy which the customer declares he has specifically read.

Clause 8: Court having jurisdiction and applicable law

These rental conditions are governed by and construed in accordance with Italian law and in particular Italian Legislative Decree No. 185 dated 22 May 1999. Should any disputes arise in connection with this agreement and fail to be resolved out of court, in the case of rentals by customers domiciled and/or resident in Italy, they shall be resolved by the Court having jurisdiction according to the regulations and the applicable procedure. In respect of rental by customers domiciled and/or resident outside Italy, disputes shall be subject to Italian law and the Law Courts of Treviso shall have sole jurisdiction.
